The Vehicle having been examined at the scene of the crash was impounded and moved to a location used by Gardai for a full inspection. (1) That the Vehicle had no Certificate of Road Worthiness (2) That the rear under run protective device was missing (3) That the trailer side lighting was not working (4) That the side markings were invisible due to dirt & grease (5) That the vehicle had defective brakes system' 17% out 100%. (6) That the upright supports for holding timber had dropped past the socket holders covering off the side light fittings. (7) That the Crane was loose on the platform (8) That studs were missing from the wheels. (9) That he allowed driver Stephen Kelly to use this Vehicle on the public road.
